Health and safety

Desk Beast is not medical advice and is not a medical device. It suggests light bodyweight exercises for general wellness. Talk to a doctor before starting any new exercise routine, especially if you are pregnant, injured, or have a heart, joint, back or other health condition. Stop immediately if you feel pain, dizziness or shortness of breath.

You are responsible for exercising safely: make sure you have enough room, and only use a desk or chair for an exercise if it is sturdy and won’t roll or tip. Stillness Alerts and other reminders are gentle nudges, not health monitoring, and they may arrive late, early or not at all.

Using Desk Beast

You must be at least 13 years old to use Desk Beast, and if you are under the age of majority where you live, you need a parent or guardian’s permission. You agree not to misuse the app, including by reverse engineering it, interfering with its operation or purchases, or using it for anything unlawful.

XP, levels, streaks, freezes, badges, quests, league ranks and your beast are part of the game. They have no monetary value, can’t be transferred or exchanged, and may be lost if you delete the app or change devices. Weekly league opponents are simulated players, not other real users.

Desk Beast Pro subscriptions

• Desk Beast is free to download. Desk Beast Pro is an optional auto-renewing subscription, offered weekly, monthly or annually. The price and length of each plan are shown in the app before you buy.
• Payment is charged to your Apple ID when you confirm the purchase, or at the end of a free trial if one is offered.
• Your subscription renews automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription in your Apple ID account settings, or from Profile → Manage subscription in the app. Cancelling stops future renewals; Pro stays active until the end of the period you’ve paid for.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• Purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• We may change Pro features or prices. Price changes apply only from your next renewal, and Apple will notify you as required.

License and ownership

Desk Beast is licensed to you, not sold, under our End User License Agreement. The app, the beast characters, artwork, animations, text and other content belong to Groot Studios LLC and are protected by intellectual property laws.

Disclaimers and limitation of liability

Desk Beast is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don’t promise that the app will be uninterrupted, error-free or produce any particular fitness result.

To the fullest extent permitted by law, Groot Studios LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury arising from exercises you choose to do, and our total liability for any claim relating to Desk Beast will not exceed the amount you paid us for Desk Beast in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you; nothing in these Terms limits rights you have that can’t be waived by law.

Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute that isn’t resolved informally will be brought in the state or federal courts located in Georgia, and you and we consent to their jurisdiction, except where the law of the place you live gives you the right to bring a claim in your local courts.

Changes and termination

We may update these Terms. We’ll change the effective date above, and for significant changes we’ll let you know in the app. If you keep using Desk Beast after changes take effect, you accept the updated Terms. You can stop using Desk Beast at any time by deleting it. We may suspend or end access to the app if you breach these Terms.
